These Terms and Conditions (“T&Cs”) govern the access and use by the “User”/ “you”/ “your” of the Platform and Services provided by SMFG India Credit Company Limited (“SMFG India Credit”/ “SMICC” / “we” / “us” / “our”), a company established under the laws of India, having its registered office at Commerzone IT park, Tower B, 1st Floor, No: 111, Mount Poonamallee Road, Porur, Chennai, Tamil Nadu, India, Pin – 600 116 and/or SMFG India Home Finance Company Limited (“SMFG Grihashakti” / “SMHFC” / “we” / “us” / “our”) a company established under the laws of India, having its registered office at Commerzone IT park, Tower B, 1st Floor, No: 111, Mount Poonamallee Road, Porur, Chennai, Tamil Nadu, India, Pin – 600116, as the case may be.

(“Privacy Policy”).
By accepting these T&Cs you agree and acknowledge that: (a) you have full legal capacity, right and authority to agree to and be bound by these T&Cs, (b) you are at least 18 (eighteen) years of age, (c) you can read, understand, access the World Wide Web/Internet in English language, (d) you are not impersonating and will not impersonate any person and entity or falsely state or otherwise misrepresent such person’s or entity’s identity.
“Affiliate(s)” shall mean group companies, associates, and/or subsidiaries of SMFG India Credit/ SMFG Grihashakti.
“Applicable Law” shall mean and include all applicable statutes, enactments, acts of legislature or parliament, laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives and orders of any Authority, statutory authority, tribunal, board, court or recognized stock exchange of India or overseas, or any determination by or interpretation of any foregoing by any judicial authority, or whether in effect as of acceptance of these T&Cs or thereafter, as amended from time to time.
“Authority” shall mean the Government of India, the government of any other state of India or any ministry, department, board, authority, instrumentality, agency, corporation (to the extent acting in a legislative, judicial or administrative capacity) or any regulatory body (including but not limited to, RBI and Securities and Exchange Board of India) exercising statutory powers under any Applicable Law under the direct or indirect control of the Government of India or the government or any subdivision of any of them or owned or controlled by the Government of India, the Government or any of their subdivisions, or any court, tribunal or judicial body within India.
“Mobile Application” shall mean mobile application owned and/or operated by SMFG India Credit/ SMFG Grihashakti.
“Platform” shall mean an interface provided by SMFG India Credit/SMFG Grihashakti through the Mobile Application and Website or otherwise, as the case may be.
“Website” shall mean the website owned and operated by SMFG India Credit or SMFG Grihashakti, as the case may be.
To avail the Services, you must create a user account (“User Account”) by providing accurate and complete information, including but not limited to your name, phone number, and email address. Failure to provide or maintain accurate information will result in breach of these T&Cs and may result in suspension or termination of your User Account. You may be required to provide additional information for the purpose of obtaining additional Services or continued use and access to the Platform or User Account.
The device used for registration for the Mobile Application will be stored as your registered device and details of registered device shall be stored by us. Logging in from a new device will require re-authentication, after which the new device becomes registered. You will not be able to access your account from the previous device until re-authentication.
If your registered phone number is deactivated, transferred, or surrendered, you must inform us immediately.
You are solely responsible for maintaining the confidentiality of your User Account credentials (password, PIN, OTP) and for all activities under your User Account. You agree to notify SMFG India Credit/ SMFG Grihashakti, as the case may be, immediately of any unauthorised use, actual or suspected, or breach of security in relation to your User Account. We shall not be liable for losses arising from your non-compliance of the requirements herein or failure to maintain confidentiality of your login credentials or sharing of OTP.
Biometric Authentication: You understand that you may opt to access your User Account through the Mobile Application by using biometric authentication. Biometric authentication is a user identity verification process that involves a biological input or the scanning or analysis of some part of the body which includes but not limited to fingerprint or face scanning. Where you opt for biometric authentication, you acknowledge and agree that you have successfully registered/ activated the biometric authentication service and biometrics registered in your device/mobile can be used to access the Mobile Application services for transactions such as login, account inquiry and serves as an instruction for any other transactions as may be determined by us at our absolute discretion from time to time using the fingerprints/face registered with your mobile device. Biometric authentication service will be in addition to the use of Mobile Application using other credentials like PIN, password, etc. You are advised not to register any third party(s)'s biometrics in your mobile device or with the Mobile Application, as by such registration, the third party(s) will be able to access your Mobile Application, to which the we shall not be held responsible whatsoever for such access or any losses or damages incurred by you as a result of such access authorised by you. You acknowledge and agree that, for the purposes of the biometric authentication service, the Mobile Application will be accessing the fingerprints/face registered in your mobile device, and you hereby consent that we can access and use such information for the provision of the biometric authentication service. You acknowledge and agree that, biometric authentication service is provided on an “as is” and “as available” basis. We do not warrant that the biometric authentication service will be available at all times, or that it will be compatible with any mobile equipment, operating system or Services that we may offer from time to time and we will not be liable any losses, damages or expenses, whatsoever, incurred or suffered by you arising from your use of or inability to use the biometric authentication service. You further understand that we will be entitled to disable, remove or withdraw the biometric authentication service at any time, without assigning any reasons or prior notice.
You are solely responsible for complying with all Applicable Laws and your obligations under these T&Cs and shall be solely liable for any liability arising from non-compliance of Applicable Laws or breach of these T&Cs.
You may be required to upload documents (“Documents”) for identity verification, eligibility checks, accessing Services offered by us or other third-parties and for undertaking financial transactions through the Platform, as may be required in accordance with Applicable Laws or our internal policies. You authorise us and our third-party service providers to process such Documents in accordance with our Privacy Policy.
We reserve the right to request additional information (“Additional Information”) for enhanced due diligence. You agree to cooperate and provide such Additional Information promptly upon request. You agree that we and our third-party service providers shall be entitled to process such Additional Information.
You hereby agree, confirm and warrant that the information provided by you including the Documents and Additional Information is true, complete, correct and current/updated. You further authorise us or our third-party service providers to verify the information/details provided by you. Where we suspect that you have provided false, incomplete, incorrect, unreliable, deficient or misleading information or Documents, or, non-disclosure of material facts and information, we shall be entitled not to provide Services to you or revoke your access to the Platform or delete your User Account. We disclaim any losses, damages or liability which may be incurred or suffered by you arising from false, incorrect, incomplete, unreliable, deficient or misleading information or Documents provided, or, non-disclosure of material facts and information by you.
You agree that it shall be your sole responsibility to ensure the correctness of any information provided by you. In case of any change in your information including KYC details and communication details (mobile number/email ID/residential or employment or communication address), you are responsible to promptly, but not exceeding 30 days, to update the same with us. You understand and agree that we do not accept any responsibility or liability for any loss or damage if any information, documentation, material, or data provided to avail the Services is incorrect, incomplete, inaccurate, or misleading, or if you fail to disclose any material fact.
Where you opt to utilise the payment services provided on the Platform to pay for Third-Party Services or products availed by you, then we would act solely as a facilitator for payment transactions between you, the sender, and recipient who receives such payments (“Recipient”). We do not provide any guarantee or warranty in respect of the goods, services or quality thereof or delivery commitments of the Recipient and you shall solely undertake entire risk of any harm, injury, losses or damages suffered from availing such Third-Party Services or products. You are advised to undertake reasonable due diligence while undertaking any payment transaction through the Platform or in relation to any Service provided on the Platform.
Payment modes made available on the Platform may involve third-party payment service providers, and transactions are subject to their terms and conditions. We shall not be liable for errors or unsuccessful payments processed by such third-party payment service providers.
You should ensure to undertake due diligence prior to transferring payments using the Platform or in relation to any of the Services provided on the Platform. We disclaim liability for any payment transactions undertaken by you, including any fraudulent transactions under your User Account occurring on the Platform.
You agree to comply with the terms and conditions stipulated by such third-party payment service providers, from time to time, in relation to the payment transactions effected under your User Account.
Where you apply to avail loan products/credit facilities through the Platforms, you agree as follows:
You may be requested to provide suggestions or feedback (“Feedback”) in relation to the Services or Platform. By submitting the Feedback, you grant us the right to freely use, disclose, and exploit such Feedback without obtaining your consent or any liability or obligation towards you. You hereby agree to waive any rights, including intellectual property rights, arising from such Feedback.
You acknowledge and agree that the offers extended by us through the Platform may vary across users based on individual eligibility and other determining factors. Any offer shall be governed by the terms & conditions in relation to such offer, as may be published by SMFG India Credit/SMFG Grihashakti, as the case may be, from time to time, and SMFG India Credit/SMFG Grihashakti, as the case may be, shall be entitled to amend, modify, replace, suspend, revoke, cancel, withdraw or terminate such offers in its sole discretion, without any notice or liability. Any decision of SMFG India Credit/SMFG Grihashakti, as the case may be, in relation to the offer shall be final and binding on the user.
You agree that we may process your information to offer you products and services (offered by us or our Affiliates or third-party partners) which you may be interested in or choose to avail including personalised offers and pre-approved loans. You understand that where you apply for a pre-approved loan offered on the Platform, it does not guarantee sanction of loan by us, and any sanction of loan shall be at our sole and absolute discretion.
We reserve the right to suspend or restrict your User Account if we suspect misuse of offers or features available on the Platform or of Services.
A person who is not competent to contract may not access this Platform and use the Services. If at any time, we are of the opinion that you do not satisfy the eligibility criteria, including but not limited to any misrepresentation, misuse of any Service or offers, fraudulent or suspicious activities or transactions, we retain all rights to disable your access to the Platform and/or suspend / terminate your use of the Services with immediate effect.
If you breach or violate any of the terms, conditions, covenants, obligations, representation or warranty under these T&Cs, we reserve the right to bar, prohibit, revoke, suspend or terminate your access/use of the Platform/Services or delete you User Account. Where we have reasons to believe that any suspicious or unauthorised or unlawful or unusual activity is being carried out by you or through your User Account, we may temporarily or permanently block or freeze or revoke your access to the Platform/Services.
You agree that we may terminate your User Account, without assigning any reasons, by giving a prior notice of 15 days. However, no such notice period requirement shall arise where the termination is due to breach of these T&Cs or where we are prohibited to provide you the access to Platform/Services or to User Account due to operation of law.
Notwithstanding anything contained herein, we shall not be liable to you for any loss or damage which you may suffer or incur due to any suspension or termination.
You agree and consent that we may use data, information and Documents provided by you, or any data or information available with us, or any data or information which becomes available to us arising out of your use of Services or Platform, for offering our and third-party products and services and/or pre-filling any of the fields available on the Platform.
Any material, information, forms, data, texts, graphics, photos, videos, contained on the Platform (“Content”) is provided for general information only and should not be used as a basis for making business/commercial decisions.
You are advised to exercise due caution and/or seek independent professional advice before entering into any investment or financial obligation based on the Content contained on the Platform. We shall not be liable for any decision taken based on the use of Content or any derivative works thereof. Use of the products or Services or access to the Platform may not be permitted in some countries in accordance with local laws and regulations. Your access or use of Services is at the sole discretion of SMFG India Credit/SMFG Grihashakti, as the case may be, subject to the respective contractual terms and conditions governing products and services offered to you, which may be amended, modified, replaced, revoked, or withdrawn at any time by SMFG India Credit/SMFG Grihashakti, as the case may be, without notice. The full range of products or services offered by SMFG India Credit/SMFG Grihashakti, as the case may be, may not be available in all locations through the Platform. All rights, title and interest in the Platform including the Content and the Services, including but not limited to software, photographs, trademarks, and service marks are owned by or otherwise licensed to us. The Content on the Platform, including any links or other terms are provided on an “as is” and “as available” basis, and is our intellectual property/licensed to us, and you shall neither yourself, nor cause any other person, to copy, reproduce, display, download, distribute, modify, or transmit the Content or any portion thereof in any manner or medium whatsoever or create any derivative works based on the Content, without our express written consent.
Except as stated in these Terms, nothing in these Terms should be construed as conferring any right in or license to our or any third party’s intellectual property rights.
Subject to your compliance of these T&Cs, we provide you a limited, non-exclusive, non-transferable, non-sublicensable, revocable and royalty-free permission to access the Platform and Services.
You do not have a right to use any of our intellectual properties including but not limited to trademarks, tradenames, logos, service marks, domain names, Content and other materials.
Any unauthorised use of our intellectual property or breach of these T&Cs would result in: (a) initiation of appropriate legal action by us against you under Applicable Laws, and/or (b) enforcing our rights and remedies against you, whether available under law or these T&Cs or otherwise.
You shall also not:
We or our Affiliates, partners, third party service providers make no representation or warranty of any kind regarding or arising out of or in relation to: (a) the Content, software, functions, material, and information available or made accessible through the Platform; or (b) the Services, including merchantability, fitness for a particular purpose, title, and non-infringement, and all warranties arising from course of dealing, usage, or trade practice in respect to the same; or (c) the functioning or use of the Platform, Services or Third-Party Services or products linked to the Platform will meet your requirements, or operate without interruptions, or be error-free, or be secure, accurate, complete, free of harmful code.
The Platform may contain advice/opinions and statements of various professionals/ experts/ analysts, etc., and we do not represent/endorse the accuracy, reliability of any of the advices/opinions/ statements/ information by such person/s. Reliance on these advice/opinions/statements shall be at the risk of the User. It is the responsibility of the User to independently verify and evaluate the accuracy, completeness, reliability and usefulness of any advices/opinions/ statements, services or other information provided on the Platform. All information provided on the Platform shall not be treated, interpreted or relied on as legal, accounting, tax, financial, investment or other professional advice, or as advice on specific facts or matters. We may at any time (without being obliged to do so) update, edit, alter and or remove any information in whole or in part that may be available on the Platform and shall not be held responsible for all or any actions that may subsequently result in any loss, damage and or liability. You are expected to keep yourself updated of any changes made in the Platform and the information available on it and these T&Cs on a regular basis, and we undertake no responsibility about advising you about any such changes. Though we will endeavour to ensure that information contained on this application platform is obtained from sources which, it feels, are reliable, we do not warrant such information’s completeness or accuracy.
Notwithstanding anything contained herein, we or our Affiliates and partners will not be liable to you or any third party for any direct or indirect, special, incidental or consequential, punitive, or exemplary loss, damage or expenses, or any loss of revenue or profits, or loss of opportunity, or loss of business or anticipated savings, loss of goodwill or loss of data, arising directly or indirectly, in relation to these T&Cs or from your use or inability to use the Platform or any linked site or inability to use by any party, or arising from, but not limited to, any defect, error, omission, interruption, imperfection, fault, mistake or inaccuracy in relation to the Platform, its Contents or Services, or due to any unavailability of the Platform or any part thereof or any Contents or Services, whether under contract, tort or otherwise, even if the we or our Affiliates are advised of the possibility of such damages, losses or expenses.
You shall indemnify, defend at and hold us, our Affiliates, and our/their officers, associates, successors, assigns, licensors, employees, directors, agents, and representatives, harmless from and against any direct or indirect losses, actions, damages, claims, demands, penalties, costs, expenses, suits, proceedings, (including, without limitation, from all damages, liabilities, settlements, costs, and attorney and legal fees and costs) arising from or relating to:
The Platform may contain links to external websites (controlled or offered by third parties). We are not responsible for the contents displayed or products / services offered on such external websites (not our websites) accessed via links provided on the Platform. Thus, we shall not be liable for any features or quality of the products/ services including its saleability, fulfilment , genuineness, merchantability, fitness for a particular purpose, title, and non-infringement of the products/services purchased by you from such third-parties and we do not make any warranty, express or implied, about the contents and validity of such external websites and you are advised to do your own independent analysis prior to purchasing any product or service from offered by such third parties or on such external websites.
The Platform provides you with the options to avail various Insurance and third-party products provided by respective Insurer and third-party. You acknowledge that insurance and/or any third-party products are not mandatory for the purpose of the loan application and disbursement of loan. It shall be your sole discretion to avail such insurance and/or any third-party products at your own risk and responsibility. All information, products, and services in respect of insurance and/or any third-party products provided on the Platform is on an “as-is” basis and without any warranty, expressed or implied.
You acknowledge and understand that your use of the Platform to avail any such Insurance or third-party product shall also be governed by specific terms and conditions prescribed by the insurer or third-party product provider. You acknowledge that SMFG India Credit and SMFG Grihashakti are a registered corporate agent with the Insurance Regulatory and Development Authority of India having below registration numbers:
You understand that we are entitled to receive remuneration for insurance and third-party products offered as on the Platform in accordance with Applicable Laws.
You agree that insurance is a subject matter of solicitation. We do not underwrite the risk or act as insurer or decide on settlement of claims.
The fees or charges charged for the Services shall be provided on the Platform for the specific Service. We reserve the right to charge such fees or charges or modify or amend such fees or charges, as we may determine, in our sole discretion from time to time, to provide you with the Services chosen by you.
You understand that any applicable taxes, duties, cess or levies (except TDS) shall be borne by you. You hereby agree to comply with applicable taxation laws and requirements in connection with use of Services.
You shall be solely responsible to bear any charges incurred from your mobile service provider or third-party services used to access the Platform.
These T&Cs shall be governed by and construed in accordance with all applicable laws of India.
All claims or disputes arising out of or in connection with these T&Cs or use of the Platform shall be referred to and finally resolved by arbitration in Mumbai in accordance with the Arbitration and Conciliation Act, 1996, as amended or replaced from time to time (‘Arbitration Act’). The dispute shall be resolved by a sole arbitrator mutually agreed by the parties within 30 days of the arbitration notice. If such mutual agreement is not arrived at within the aforesaid 30 (thirty) days period, the arbitrator shall be appointed as per the provisions of the Arbitration Act. The seat of arbitration shall be Mumbai and the arbitration proceedings shall be conducted in the English language. The decision of the arbitrator shall be final and binding.
Subject to above, any dispute concerning these T&Cs shall be subject to the exclusive jurisdiction of the courts of Mumbai, India.
Failure on our part to enforce a breach of any of terms under these T&Cs or to exercise any right or privilege conferred upon us under equity, law or otherwise, shall not be construed as a waiver on our part of any terms, conditions, rights or privileges, but the same shall continue and remain in full force and effect, nor will any waiver provided in writing affect any subsequent breach or subsequent action in that behalf. All the rights or remedies herein conferred upon or reserved to either party shall be cumulative and shall be in addition to every right and remedy existing at law or equity or by statute and the pursuit of any one right or remedy shall not be construed as a waiver of other rights and remedies.
We reserve the right to change the information provided on the Platform, including the terms of this T&Cs, at any time and without notice by posting or uploading the updated/modified version of these T&Cs on the Platform and such updated/modified version shall supersede any previous version and shall become immediately effective upon posting or uploading on the Platform and shall be binding on you. However, we do not undertake to update or keep updated, the Content contained on the Platform from time to time. It is recommended that you review the information provided on the Platform, including these T&Cs, periodically for changes. We shall not be held responsible for all or any actions that may subsequently result in any loss, damage and or liability on account of such change in the Contents or information on the Platform.
We may assign our rights to any of its Affiliates, subsidiaries, or parent company, or to any successor without any prior notice to you.
We do not promise or guarantee any continuous availability of the Platform or that they shall be kept updated or that the updated versions of the Platform will be compatible with your mobile/computer devices or operating systems.
